Hospital Fraud Suspect Released on R200k Bond in R635m Procurement Case

Bail of R200,000. That was the Specialised Commercial Crimes Court’s determination for Stefan Joel Govindraju, 37, on Monday, as the Palm Ridge Magistrates’ Court processed his release pending trial in a procurement fraud case valued at more than R635 million linked to Tembisa Hospital.

Govindraju was arrested by the Hawks at OR Tambo International Airport on Friday. He faces charges of fraud, corruption, forgery and uttering, contravention of the Public Finance Management Act, and money laundering. The allegations centre on collusion with officials in the Gauteng Department of Health to manipulate the hospital’s procurement process on a systematic basis.

The National Prosecuting Authority did not oppose bail. NPA spokesperson Kaizer Kganyago, speaking to media outside court, cited Govindraju’s cooperation with investigators dating to 2023 as the decisive factor. “We have no reason not to give him bail because he has been cooperating with us throughout, as far back as 2023. Therefore, there was no reason for us to apply for bail not to be granted,” Kganyago said.

Negotiations with Govindraju regarding related matters are ongoing. Kganyago declined to detail their content but indicated the court would be informed in due course. “The negotiations are happening, but I can’t divulge what the contents of those negotiations are. They will be brought to court when we are ready, and possibly when we come back for the next appearance, then maybe we begin.” He also stressed the coordinated character of the investigation, noting that “the wheels of justice are moving in relation to the relationship between all the law enforcement agencies, the Hawks, SIU and ourselves.”

At the core of the case is a deliberate strategy to circumvent National Treasury oversight. Hawks national spokesperson Colonel Katlego Mogale explained that hospital officials allegedly colluded with service providers to exploit the request-for-quotations system for transactions kept below the R500,000 threshold, a ceiling that triggers formal tender requirements. “This approach was intentionally employed to circumvent the formal tender process,” Mogale said. Splitting contracts to stay beneath that threshold is precisely the mechanism the Special Investigating Unit later identified across the broader Gauteng Department of Health scandal.

The SIU’s findings were stark. More than R2.04 billion was allegedly siphoned from the department through 207 front companies and nine syndicates. Those findings built directly on concerns raised by Babita Deokaran, a senior Gauteng health official who had specifically flagged the contract-splitting practice at Tembisa Hospital. Deokaran was killed outside her home in August 2021, months after exposing the scheme. Six men have since been convicted of her murder and are serving sentences ranging from six to 22 years.

Govindraju’s next appearance is scheduled for September 29 at the Specialised Commercial Crimes Court at Palm Ridge Magistrates’ Court. Whether the NPA’s ongoing negotiations with him will produce a formal arrangement by that date, and what implications any such arrangement might carry for the officials within the Gauteng Department of Health who allegedly colluded with him, remains the central accountability question the court will eventually have to answer.
